The action was initiated on March 7, 1947 by the service of an alternative writ of mandamus issued upon the petition of State of Wisconsin ex rel. International Union, United Automobile, aircraft and Agricultural Implement Workers of America, C.I.O., Local 180, and Harvey Kitzman, President of Local 180 against L. E. Gooding, J. E. Fitzgibbon and Henry C. Rule, as the Wisconsin Employment Relations Board, and Walter Kwapil, Acting Secretary, directing the latter to make available to petitioners a certain petition on file with the board. The latter petition was signed by citizens of Racine and requested defendants to order an election among the employees of the J. I. Case plant at Racine to determine whether such employees were willing to accept an offer of the company to settle a strike at the companys plant.
